Terms & Conditions
‘Contract’ means the contract between you and Balloons Over Britain for the sale and purchase of vouchers ordered by you.
‘Vouchers’ means the Balloons Over Britain monetary or gift vouchers you have ordered.
‘We’, ‘Us’ or ‘Our’ means WonderDays Ltd, trading as Balloons Over Britain, company registration number 11879155, registered office - Jesson House, Stafford Court, Telford TF3 3BD
‘Supplier’ or ‘Provider’ refers to the company fulfilling your experience.
‘You’ or ‘Your’ means the user of the website and/or the buyer of any vouchers if gifted.
‘Experience’, ‘Activity’ or ‘Adventure’ pertains to the experience that has been purchased.
Nothing in these Terms and Conditions will affect any of your rights as a customer under any applicable legislation.
You must be at last 18 years of age and have legal capacity to buy any vouchers from us.
We reserve the right to refuse access or to change the content of any experience, reject any order or terminate any account you may open with us.
All experiences on our website are subject to changes and whilst we aim to be as accurate as possible, we are not legally responsible for any experience and media content provided to us and subsequently used on our website/ Promotion.
We only deliver vouchers to delivery addresses in Mainland United Kingdom.
2. YOUR ACCOUNT
You must ensure that all information you supply to us in relation to your account is complete and remains accurate.
You are responsible for protecting and maintaining the confidentiality of voucher credentials used to log in, ensuring there is no possibility of unauthorised access.
Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the individual’s prior consent.
Any order you place to buy vouchers featured on our website is your offer, to us, to buy the vouchers. We may contact you using the details provided by you, confirming the details of your order. This is not acceptance of your order. The contract has begun on your receipt of any vouchers from us.
4. PRICE & PAYMENT
The price of any experience will be the price displayed on our website when you place your order. Prices include VAT where chargeable, at the current rate. However, errors may occur and incorrect price for an experience you have ordered may be shown on our website. We will let you know if we discover any error in the price of those vouchers and give you the option to confirm or decline the order. If we cannot contact you, the order will be cancelled.
You must pay the purchase price for the vouchers by credit or debit card, Apple Pay, Google Pay or PayPal. It is your confirmation that the card details provided belongs to the person submitting the order, If you pay via Apple Pay, Google Pay or PayPal, you agree to be bound by any terms and conditions also imposed by those companies respectively.
You will become the owner of any vouchers you order on this website when the vouchers are delivered. However, if you cancel your order within the allotted time, ownership of the Voucher reverts back to us on the date of cancellation.
If you fail to provide us with a correct delivery address or do not accept delivery of your order, we may terminate the Contract by notice to you and return the cost of your order, less any delivery/ packaging charges, as soon as possible, but in any event within 14 days.
We will deliver your order to the delivery address stated in your order. Estimated delivery times are given in working days. We endeavour to deliver within the outset periods but will not be liable for any reasonable or unavoidable delay in the delivery, nor any damage or loss of the vouchers.
If you request that we deliver your order by express or special delivery, it must be signed for on delivery by someone who is at least 18 years old.
6. VOUCHER ENTITLEMENT & VALIDITY
Each voucher is valid for 12 months, unless otherwise stated on the voucher.
Each experience entitles you to the experience details outlined on our website, for the number of recipients selected.
All vouchers must be redeemed, booked and taken within the 12 month validity, unless otherwise stated.
It is your responsibility to ensure you have enough time to book and take your experience within the specified validity.
If you change your mind, refunds can be made on the price paid for unused vouchers, products and gift cards within 30 days of purchase. Refunds cannot be given for vouchers that have been used to either redeemed with, booked or ordered with the supplier.
Once an experience has been booked with an experience provider, you are bound by their terms.
Refunds cannot be given on expired, extended or exchanged vouchers.
Refunds can only be made to the original purchaser and monies will be refunded directly to the original method of payment.
A written (including email) request for a refund must be made within 30 days of purchase. In the event of a refund being applicable, we will refund to your credit or bank debit card, minus any applicable charges.
If you are not the original purchaser but have changed your mind about an experience within 30 days of purchase, provided the voucher hasn't been used to redeem, book or order with a supplier in this time, Balloons Over Britain can credit the amount paid onto a gift card for use on another experience.
A written (including email) request for a credit onto a gift card must be made within 30 days of purchase.
Postage charges are non-refundable.
Your statutory rights are not affected.
Experience vouchers can be extended, during the validity of the voucher (providing the voucher details haven’t been provided to the supplier), at an additional cost of £20, for a period of 6 months.
If the experience cost has increased since the time of purchase, the difference is also payable in the event of an extension being purchased.
9. EXPERIENCE AVAILABILITY & TIMINGS
Any availability, booking options, locations and equipment used etc. are given as a guideline only, these are subject to changes and are outside of our control, for this reason we cannot be held responsible for any discrepancies.
On the day you may be required to wait between the different elements of an experience, alongside other participants.
10. EXPERIENCE RESTRICTIONS
Restrictions can include (but are not restricted to) height, weight, age, medical and physical restrictions by experience and location. It is your responsibility to ensure that you purchase a suitable experience for the participant.
Once you book a specific date with a supplier, you are bound by their terms and conditions regarding cancellations. It is not possible to change a date unless agreed directly with them. Where a booked date cannot be altered, we will not offer a refund or honour an experience. The voucher would be void if the experience is not attended.
In the event of a supplier having to cancel an event due to reasons beyond their control i.e. weather, they will contact you directly. In this event, another date would be booked. In the event of a cancellation, Balloons Over Britain will not be held liable for any costs incurred, including travel expenses, pre-booked accommodation costs or any other costs incurred.
12. LIABILITY & SUPPLIERS
When redeeming or booking, your vouchers become non-refundable/ exchangeable (please refer to paragraph 7), at this point you are entering a separate agreement with the provider and will be bound by their terms and conditions, including restrictions they apply.
We only supply experiences from companies that hold relevant insurances etc. However we are not liable for the safety standards or quality of the delivery of any experience or any loss or damage incurred, this is the responsibility of the provider.
Neither Balloons Over Britain nor the provider are liable for any restrictions including but not limited to weather conditions, location changes or technical breakdowns, resulting in postponement of an experience.
We have tried to ensure all descriptions, details and imagery are correct, however this is intended to give an idea of the experience provided and does not form part of a contract between the purchaser or recipient and Balloons Over Britain.
The undertaking of any experience provided may involve some personal risk. Some providers may require or request a disclaimer to be signed, or additional insurances to be taken out on the day of the experience, please read through any information given to you carefully.
13. INTELLECTUAL PROPERTY
All copyright, trademarks and other intellectual property rights in or relating to the design of this website, its contents and all materials made available as part of your use of this website have been provided by our suppliers. Any copyright or trademark queries must be queried with the relevant supplier.
The Contents of, and the materials available through this website may be only used by you and for your personal use in connection with your use of this site, you may not copy, reproduce or commercially exploit any such materials or contents, although you may download such materials or contents strictly for the purpose of your use of this website.
You must not use our website for any unlawful purpose or activity.
14. VOUCHER SECURITY
Our vouchers are valuable documents, we accept no responsibility for lost/ stolen or damaged vouchers, or vouchers that have been altered or tampered with.
15. THIRD PARTY & RESALE
Balloons Over Britain vouchers are not valid for re-sale. Any vouchers purchased via re-sale will be considered invalid and its value considered null and void. Neither we nor any of our suppliers will be under any obligation to provide any service in respect to re-sold vouchers without prior consent.
16. GOVERNING LAW
The Laws of England will apply to the contract and all claims and legal proceedings arising in connection with it will be subject to the non-exclusive jurisdiction of the Courts of England.
